The terms and conditions set out below apply to all orders placed with PinoyCPA for all the products and services offered on PinoyCPA.com website unless otherwise indicated in writing. The present terms and conditions will be systematically displayed when you place an order.

As a consequence, placing an order, you agree to be bound by these terms and conditions.

Prices

The prices guaranteed to you are those displayed on the website when you place your order. However, they are subject to change without notice in the event of specific conditions related to economic circumstances, duties and taxes, a change in labor or raw material cost, your specific requirements etc.

All prices are indicated in PHP or USD according to your choice of currency and do not include delivery charge, which will be automatically calculated and indicated in your order form (shopping cart).

All prices are inclusive of VAT at the rate appropriate to the country of receipt.

Export sale prices are understood to be FOB Manila. Custom clearance, the payment of duties and other taxes are at your own expense.


Purchase of products

   1. Your shopping cart is your order form.

   2. If you choose to place an order, you will have to enter all the information required for invoicing and delivery of the products. You are responsible for the information you provide. In the event of a mistake in the delivery address, the website owner of PinoyCPA.com shall not be held responsible for failing to deliver the item(s).

   3. After confirming your details, you will choose a method of payment. Your order will be automatically confirmed and will constitute an irrevocable commitment to purchase, only called into question in the limited number of cases set forth in the present conditions (see Cancellation clause).

All orders are considered final and can only be cancelled with the consent of PinoyCPA, subject to conditions that will compensate them with any damage incurred by this cancellation.


Order confirmation

At each stage of the processing of your order (confirmation, possible availability change, dispatch) an email will automatically sent to you provided there is no mistake in the electronic address you entered in the registration form. In the email that will confirm that your order has been processed and your parcel shipped, you will get a tracking number and a link to the carrier's website to track your order.

PinoyCPA.com  reserve the possibility of declining to confirm an order for a specific reason (a problem related to the received order or a problem of supply of the items). PinoyCPA.com has 5 working days to inform you that it cannot deliver the order and ask you to bring changes to your order or cancel it.


Payment

Payment in full is due when the order is placed. It can be made:

- By direct bank deposit - this is the best option when ordering within the Philippines. We will provide you with our bank account details upon confirmation of order. You can deposit cash or check to our bank account.  You can also wire payments locally.  Note that your order will only be dispatched upon receipt and validation of your payment via email.  

- By Paypal - This is required for international purchases and you will need to have a Paypal account. We advise you to choose this method of payment because it is the easiest, fastest and highly secured.  PinoyCPA.com has chosen a highly secured payment tool that can accept all major credit cards. This quality label in Paypal guarantees secured on-line payment for all your purchases.

Online payment by card uses SLL (Secure Socket Layer) via Paypal Merchant payment system. The information transmitted is encrypted by sofware and cannot be read when it is being transmitted through the network. You will note that the transmission is encrypted by sofware as soon as the padlock symbol appears on your browser. Besides, when your banking details (card number, expiry date and cryptogram) are being transmitted, the URL address becomes an https URL ('s' standing for security) and is no longer an http address.

After confirming their shopping bag, customers will have to choose PayPal payment option, then enter their email address, password, amount and currency. Paypal is an intermediary between the buyer and PinoyCPA.com, and debit and credit operations are almost instantaneous in PayPal accounts.

Customers will be able to check that the transaction was made by logging in to their PayPal account.  Customers are not required and should not provide PinoyCPA or a third party with their banking details.

- By Western Union - another option for international order is to pay via Western Union.  You will need to contact us if you plan to make payments thru Western Union.


Orders are dealt with upon receipt of confirmation of payment (via email), which is deemed to be irrevocable, cash, net and not subject to discount.


Geographic zones and delivery times

We will deliver your items as specified on your shipping address. If you wish to have them delivered to another address, to a friend, a neighbour or your workplace, etc., simply indicate it when you place your order and/or choose gift wrapping option.  A delivery period will appear when you choose your delivery option.

PinoyCPA.com  has chosen the following delivery options for the delivery of your orders:
- Air21 for local deliveries within the Philippines
- EMS for not-so-urgent international deliveries
- Fedex for next day deliveries

Shipping options depend on delivery countries.


In the case of a delay in the delivery, you must contact in the first place the carrier or its distributor (for the post office) to check with them if they do not hold your parcel. If necessary, you must contact PinoyCPA.com  Customer Service by email in order to lodge a claim or request an enquiry to track your parcel.

In the event of a significant delay, we undertake to give you compensation by paying the delivery costs on your next order. However, time limit exceedance cannot lead to any compensation for damage, to any discount or to the cancellation of the current order in the event of total or partial strikes, whether internal of external to the company, transport or supply blockade, governmental or legal restrictions etc. Neither shall PinoyCPA.com  website be held responsible if your parcel is held up at a border due to rules and regulations or any other event.


Cancellation clause and returns

Within the framework of mail order selling (when the parties are not present simultaneously), you have a 7-calendar day limit to exercise your right of cancellation without having to give any reasons or pay penalties, except for return costs by informing us via email. The time limit above-mentionned runs from the day you receive the goods.

A store credit will be issued, along with a code to use it (you will find them in 'My vouchers' section in 'My account'). At any time, you may choose to get a refund (except for delivery costs) by cheque.

The claim of cancellation applies without penalties, except for return costs.


Claim

Claims or complaints will always be dealt with attentively and respectfully. In the event of dispute, you must first write to PinoyCPA.com so as to obtain an amicable resolution via our contact form in the 'Contact' section on PinoyCPA.com  website.

Failing this and subject to the customer's status as a 'trader', any dispute relating to the interpretaion or execution of the present terms and conditions will be under the jurisdiction of the Commercial Court of Philippines.

Guarantees

PinoyCPA does not directly manufacture the products displayed on www.PinoyCPA.com.

Accordingly, the manufacturer only will be responsible for any damages suffered by a person or property caused by a product defect, of the information given on the package of the aforementionned product. Furthermore, you should be aware that the products, services and information offered by PinoyCPA.com  shall not replace in any case the adults' constant vigilance.

PinoyCPA shall not be held responsible in the event it does not comply with the rules and regulations of the country where the products are delivered. You are responsible for checking with local authorities if it is possible to import or use the products or services you consider purchasing.


Privacy Policy

We will treat all personal data as confidential.

In compliance with the laws on privacy online, the website grants you the right to access and rectify data that concern you. You may exercise this through the contact form in PinoyCPA.com  'Contact' section.

When you create a customer account, place an order or in the case of any other specific online operations, PinoyCPA.com  will offer you to receive its newsletters, promotion offers and/or to subscribe to be informed of the date of our exclusive sales and to receive offers from PinoyCPA.com  partners. At any time you may bring changes to your subscription through 'My personal information' section in 'My account' or via the hypertext link which will appear at the bottom of the page when you receive offers by email.

If you do not have an account, you will have to enter your email address in the Newsletter section to unsubscribe.

PinoyCPA undertakes to take account of any changes in your subscription or cancellation of subscription to commercial emails brodcasted on the website, as soon as possible, functions of required procedures.



Intellectual Property Rights


All contents on www.PinoyCPA.com , whether visual or sound elements, including the underlying technology, are protected by copyright laws on brands and patents.

It is imperative for users with their own website who wish to post a simple link to PinoyCPA.com  website homepage for personal use to get an authorization from PinoyCPA. In any case, any link, even with implied agreement, will be removed on PinoyCPA's request.

Accordingly, partial or total reproduction in any medium whatsoever of the elements comprising the site, use of such elements and allowing third party to use them are strictly forbidden and will systematically give rise to legal action.


Entire Terms and Conditions

Any changes in the legislation, in the rules and regulations or notification of a Court judgment which would make one or several clauses of these terms null and void shall not render the present terms and conditions invalid. In all cases, customers shall not fail to comply with these terms and conditions even in the event of a change or certified report.

If any of the conditions was not specifically mentioned, it would be subject to prevailing practices and customs of online selling companies whose head office is in Philippines.


Duration and application

The present terms and conditions apply as long as PinoyCPA.com services. They can be modified by PinoyCPA.com at any time.


Liability

PinoyCPA has a performance obligation for all the stages from receiving an order to all the stages subsequent to the signing of the contract.

PinoyCPA undertakes to give an accurate description of the products which are sold on PinoyCPA.com  website.

On the other hand, PinoyCPA shall not be liable in the case its failure to perform its obligations would be imputable to the insuperable and unforeseen fact of a third party or to an instance of force majeure as set out in the Philippine laws.

PinoyCPA shall not be held responsible in the event it does not comply with the legislation of the country where the product is delivered. It is the Customer's responsability to check with local authorities whether it is possible to importe or use the products he wishes to purchase.

PinoyCPA shall not be liable for any damage incurred by the use of the Internet network such as a service breakdown, the occurrence of a computer virus or intrusions or more generally in all cases of force majeure as set out in Court.
